The Genesis and Formation of the Concept of the State of Intoxications

Abstract

The subject of the article is to present the concept of “intoxication” in Polish legislation and to analyse attempts to define it by representatives of legal, medical and biological sciences and the resulting statutory definitions. The main aim of the research theses was to demonstrate tha the currently applicable statutory definition of intoxication – by showing the long path of its evolution – has a solid basis in the achievements of medical science. The study is of significant importance for science, because it contains an in depth dogmatic analysis, and for practice, primarily due to facilitating the understanding of individual elements of its definition. It was also necessary to include considerations on the state indicating the use of alcohol or states after the use of alcohol, which are related to the consumption of alcohol, which also have a normative character
